Official Rules

THE “FRESH FACE OF SOFFE 2012” PROMOTION (THE “PROMOTION” OR “SWEEPSTAKES”) IS OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO AT THE TIME OF ENTRY ARE 15 YEARS OF AGE OR OLDER AND WHO REGISTER FOR AND ATTEND THE CHEERSPORT NATIONALS EVENT TO BE HELD IN ATLANTA, GEORGIA ON FEBRUARY 17-19, 2012.  Employees of M.J. SOFFE, LLC and ITS parents, affiliates, subsidiaries, and other affiliated companies, agents, advertising and promotional agencies, and their immediate family members or persons residing in the same household of such employees, are not eligible to enter or win.  
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. 
VOID IN PUERTO RICO, U.S. VIRGIN ISLANDS, U.S. TERRITORIES AND POSSESSIONS AND WHERE PROHIBITED OR RESTRICTED BY LAW. 
1. SWEEPSTAKES PERIOD: 
The Sweepstakes begins December 10, 2011, at 12:01 a.m. EST and ends February 12, 2012, at 11:59 p. m. PST (the “Sweepstakes Period”). 
2. HOW TO ENTER:
To enter, eligible participants must submit a recent photograph of themselves, a typed (in 10-point Arial font), original essay of 500 words or less explaining why the participant has what it takes to be “The Fresh Face of Soffe”, the participant’s current grade point average (GPA), a comprehensive list of the participant’s athletic and community involvements and affiliations, and the participant’s full name, age, complete mailing address, telephone number, and current e-mail address, via one of the following two methods: (1) via e-mail to: fanclubcontests@mjsoffe.com or (2) via first class U.S. Mail, postage prepaid, to: Soffe Fan Club, The Fresh Face of Soffe Contest 2012, One Soffe Drive, Fayetteville, North Carolina 28312.  Mail-in entries must be postmarked by February 10, 2012, and received by February 15, 2012.     
Eligible participants are limited to one (1) entry to the Promotion.     No copies or mechanical reproductions of entries will be accepted.  Neither Sponsor nor any of its employees, representatives or agencies, is responsible for lost, late, damaged, delayed, destroyed, misdirected, postage-due, incomplete, or illegible entries or electronically-submitted entries, or portions thereof, that Sponsor is unable to access due to technical issues.  Entries that are photocopied, mechanically reproduced, tampered with, illegible, incomplete, or not in strict compliance with the requirements of this section are not eligible for entry and will be discarded.
Entrants must be present at the above-referenced Cheersport Nationals event in order to win. 
Once submitted, entries become the exclusive property of Sponsor and will not be returned.
For a copy of these Official Rules, send a self-addressed, stamped envelope to: Soffe Fan Club, The Fresh Face of Soffe Contest 2012, One Soffe Drive, Fayetteville, North Carolina 28312, by February 12, 2012. (Vermont residents may omit return postage).
3. ELIGIBILITY: 
The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia who at time of entry are 15 years of age or older and who register for and attend the Cheersport Nationals event to be held in Atlanta, Georgia on February 17-19, 2012. Employees of M.J. Soffe, LLC and its parents, affiliates, subsidiaries, and other affiliated companies, agents, advertising and promotional agencies, and their immediate family members or person residing in the same household of such employees, are not eligible to enter or win.  
4. SELECTION OF WINNERS/ODDS OF WINNING PRIZES: 
One (1) individual will be selected to win the Grand Prize.  Two (2) individuals will be selected to win the Second Prize. On or before February 19, 2012, the winner of the Grand Prize and the winners of the Second Prize will be selected by a panel of judges designated by Sponsor, and such selection will be in the panel’s absolute and sole discretion.  The winners will be announced at the above-referenced Cheersport Nationals event.
Odds of winning the Grand Prize or Second Prize depends on the total number of eligible entries received as of the appropriate cut-off date.  Participants agree to be bound by these Official Rules and by the decisions of the judges, which are final and binding in all respects.  Winners will be notified by e-mail or telephone.   
Winners must comply with all of the terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.  Winner(s) may be required to sign and return an Affidavit of Eligibility and Release within 14 days of notification in order to receive the prize(s).  Travel companion(s) will be required to sign and return a liability release not less than 14 days before departure date or will not be permitted to accompany winner on trip.  In the event of non-compliance with these requirements, the prize will be forfeited and an alternate winner will be selected.  If prize/prize notification is returned as undeliverable, the prize will be forfeited and an alternate winner will be selected.  Unclaimed prizes may not be awarded. 
5. PRIZES: 
Sponsor will award one (1) Grand Prize during the Promotion and two (2) Second Prizes. 
Grand Prize
The Grand Prize consists of the following:

  1. Official designation as the “2012 Fresh Face of Soffe” and, at Sponsor’s sole and absolute discretion, consideration by Sponsor for inclusion in certain of Sponsor’s advertisements, commercials, videos, and websites (including the possible authoring of blogs and other efforts on Sponsor’s social media outlets).
  2. A complete Soffe wardrobe consisting of one (1) item of each style offered by Soffe as of February 17, 2012, in the color and size of the Grand Prize winner’s choice (Approximate Retail Value (“ARV”): $700.00).
  3. A trip for winner and one (1) guest for two (2) nights to New York City (ARV $3000). (Actual value may vary based on airfare fluctuations and distance between departure and destination).  The trip includes round trip airfare from the nearest airport to the Grand Prize winner’s home (as determined by Sponsor) to New York City, one (1) rooms deluxe hotel accommodations for two (2) (double occupancy), an all-expenses paid visit to a spa in New York City selected by Sponsor to include haircut and styling and other options as determined by Sponsor, and One Thousand and 00/100 Dollars ($1,000), to be paid via check, for Grand Prize winner to utilize while in New York City.

If winner cannot travel for any reason whatsoever after all travel arrangements are made, winner will forfeit prize and Sponsor may, at its sole discretion, award the prize to an alternate winner.
Second Prize
The Second Prize consists of the following:

  1. At Sponsor’s sole and absolute discretion, consideration by Sponsor for inclusion in certain of Sponsor’s on-line advertisements and websites (including the possible authoring of blogs and other efforts on Sponsor’s social media outlets).
  2. Soffe Authentic Shorts in every color offered by Sponsor as of February 17, 2012, in the size of the Second Prize winner’s choice (ARV: $263.67).

All prizes are non-transferable.  All taxes or expenses, including, without limitation, meals, gratuities, transportation costs, transportation to and from airport, sales tax, luxury tax and any other costs incurred in claiming or using any of the prizes, are the sole responsibility of the prize winner.  No prize substitution or cash equivalent of prize, except at Sponsor’s sole discretion, and then only for a prize of equal or greater value.  Any difference between the actual value of any prize and the approximate retail value set forth in these Official Rules may not be claimed and will not be awarded. 
6. GENERAL CONDITIONS:
(a)  This Sweepstakes is subject to all federal, state and local laws and regulations.  The laws of the United States of America shall be deemed to govern the Sweepstakes. 
(b)  Acceptance of prize shall constitute and signify the winner’s agreement and consent that Sponsor may use her name, address (city and state only), likeness, and/or prize information for promotional purposes without further compensation, where legal  (Tennessee residents need not consent to, or sign any, publicity release.) 
(c)  Participants, by participating, release and agree to hold harmless Sponsor and its parents, affiliates, subsidiary companies, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, losses, tax liabilities or damages of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in any Sweepstakes related activity, or participation in the Sweepstakes. 
(d)  Sponsor and its parents, affiliates, subsidiary companies, advertising and promotion agencies and contest administrators and their respective directors, officers, employees, representatives and agents are not responsible for any typographical or other error in the printing of the Sweepstakes, administration of the Sweepstakes or in the announcement of the prizes.  Sponsor reserves the right to modify the Sweepstakes rules, terms and conditions without materially affecting the terms and conditions of the Sweepstakes. 
(e)  Except where prohibited, participants agree that:  (1) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prize awarded, or the determination of the winner(s) shall be resolved individually, without resort to any form of class action, and exclusively under the laws of the State of South Carolina and through the courts of Greenville County, South Carolina; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and (3) under no circumstances will participants be permitted to obtain awards for and participants hereby waive all rights to claim punitive damages, incidental damages, consequential damages or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Without limiting the foregoing, all prizes are provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 
(f)  If for any reason the Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes.  In such event, Sponsor may award prizes in a random drawing from all eligible entries received up to the date of cancellation or suspension. 
(g)  Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, registrations or entries.  Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any registration, e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to a participant's or any other person's computer relating to or resulting from participation in the Sweepstakes or downloading any materials in the Sweepstakes.
(h)  WARNING:  ANY ATTEMPT by a PARTICIPANT or any other person TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) TO THE FULLEST EXTENT PERMITTED BY LAW, including seeking criminal prosecution.
7. WHO WON:  To receive the a list of winners by mail, send a written request, accompanied by a self- addressed, stamped envelope to:  Soffe Fan Club, The Fresh Face of Soffe Contest 2012, One Soffe Drive, Fayetteville, North Carolina 28312, by August 12, 2012.
8. SPONSOR: 
The Sponsor of this Sweepstakes is M.J. Soffe, LLC.  The administrator/operator of this Sweepstakes is Sponsor.
